Terms of Service



This HostPaket.net Service Agreement (the "Agreement") describes the terms and conditions on which HostPaket.net ("we" or "our company") offer services to you ("Customer" or "You"). By registering for or using or visiting HostPaket.net services, Customer agrees to be bound by the following terms and conditions.

By receiving services from "HostPaket Internet and Informatics Services" (hereinafter referred to as HostPaket) and/or HostPaket Website (www.hostpaket.net), you will be deemed to have accepted all of the terms in this agreement. HostPaket, the preparers of all kinds of content on this site, its employees, the persons and organizations authorized by HostPaket have no criminal and legal responsibility for your claim for any material / moral damages that may arise from your failure to read these terms or to act in accordance with them.

HostPaket has the right to unilaterally update and change this agreement at any time without prior notice.

All kinds of information, statistical figures and values contained in the HostPaket Website have been obtained and compiled from sources whose reliability is accepted within the framework of general practices, and their accuracy and adequacy are not guaranteed by HostPaket in any way. HostPaket has no personal, legal and criminal liability for any direct or indirect material and/or moral and/or moral negative and/or positive damages and possible other damages and expenses that may arise as a result of the use of the information, evaluations, comments and statistical figures and values contained on the HostPaket website.

It is assumed and accepted by you that you have read the warnings and statements in this agreement before receiving service from HostPaket, and in case of any dispute, claim and demand in this regard, it is declared by HostPaket that these phrases written on this web page and all other computer records belonging to HostPaket will be presented as the sole and real exclusive evidence, and it is accepted and undertaken by the person (s), organization (s) entering this HostPaket Website.



1.) Orders and Service Delivery
After your order is checked for fraud and your payment is received, your account will be set up and your information will be sent to you. Although domain name, web hosting and reseller hosting accounts are automatically set up for payments made by credit card and other payment methods, the setup process can take up to 48 hours in case of a possible problem. For VDS and rental server services, the installation time is 48 hours unless otherwise specified. Delivery time for software and license services is maximum 1 week unless otherwise specified in writing/verbally. If delivery is not made within the specified time period, HostPaket has the obligation to refund your fee upon request.

At the time of ordering, it is your responsibility to provide a problem-free e-mail address that you actively use. In case of any irregular behavior or in cases where we need to reach you, the e-mail address you provide will be used. It is your responsibility to keep your e-mail address up to date and check it continuously, all e-mails sent to you are considered as received. HostPaket has no legal and criminal liability for any damages and losses that may occur if the e-mails sent to you do not arrive or are not read by you.

All information in the form you fill out during the order or when registering on our site must be correct and complete. For orders canceled due to incorrect information, HostPaket reserves the right not to refund or partially refund the fee.

HostPaket may request a credit card photocopy/scanned image or ID photocopy/scanned image for security purposes when it deems necessary. If you do not provide these, your order may be canceled and treated as fraudulent or the service(s) you receive may be suspended. For accounts suspended due to fraud, HostPaket has the right not to refund or partially refund.

2.) Content
The terms of all services provided by HostPaket are governed by the laws of the Republic of Turkey.

By using the services provided by HostPaket, you cannot impose any legal liability on HostPaket, you bear full legal responsibility for any action you take by using the services provided to you.

It is forbidden to violate any copyright or registration rights by using our services. This includes unauthorized music, books, photographs or other copyrighted material. In addition, we are prohibited by law from hosting pornographic/erotic content and content that can be used for hacking. Selling in violation of copyrights and/or hosting pornographic/erotic content will result in immediate termination of the service(s) you have received. In the event that content that violates copyrights and/or can be used for hacking is found, this content will be deleted or access to the content will be blocked. In case of repetition, the service may be suspended/terminated. If you believe that such content is being hosted using the services provided by HostPaket, you can send an e-mail to "destek **@** hostpaket.net" to file a complaint. HostPaket may request more information/documentation/documents from you regarding your complaint.

In case of complaints regarding illegal acts committed using the services provided by HostPaket, the service may not be terminated if HostPaket cannot verify the reason for the complaint or cannot be sure whether the act constitutes a criminal offense. HostPaket is not legally authorized to decide. In such cases, you should seek your rights legally against the person who committed this action. HostPaket has no legal and criminal liability for any damages and losses that may occur in such cases.

All services offered by HostPaket are only for use within the limits permitted to you. In any way, if you access a content/file/service that is not authorized to you, it is your responsibility to notify HostPaket without using it. Otherwise, it is your responsibility to cover any material / moral damages you may cause.

HostPaket may monitor the site contents and/or any access for legal reasons, for system management purposes, to track unauthorized access, to verify security procedures and/or for operational security purposes. During monitoring, the contents/information may be tested, recorded, copied or used for the purposes described above. HostPaket will not use or share your content in any way other than for the purposes described above.

HostPaket has the right to provide service to whom it wishes or not to provide service to whom it wishes. HostPaket has the right to delete / block access to content that is contrary to the contract, provocative, divisive, illegal or inappropriate with or without warning. In such cases, HostPaket has the right not to refund or partially refund the fee.

Illegal content will be reported to the authorized units.

Uploading content such as infected content and shell scripts that may damage HostPaket servers may result in complete termination of your account without refund. You are liable for all material / moral damages caused to HostPaket and / or other users in these ways. It is your sole responsibility to ensure the security of your account.

In the services you receive from HostPaket, you are responsible for ensuring that the software/scripts/programs installed on your account are secure and that the permissions given to directories are correct. Users are responsible for every action taken on their account. This includes the username and password. You must use a secure and unguessable password for your accounts. You are also responsible for any malware that may be installed on our servers using your account. If necessary, HostPaket has the right to terminate your services without refund or partial refund. HostPaket will not accept any legal and criminal liability for any material / moral damages that may occur in this regard. You shall be liable for all pecuniary/non-pecuniary damages caused to HostPaket and/or other users using your account.

HostPaket has the right to request you to modify any website, database, account or any other material/service.

3.) SPAM Prohibition
HostPaket has absolutely no tolerance for unsolicited e-mails, bulk e-mails and spam e-mails. If you do not comply with this, the service/services you receive will be terminated with/without notice. All services that cause our IP block to be included in e-mail black lists will be terminated without notice.

HostPaket has the right to charge the person who caused the IP block to enter the e-mail blacklists the necessary fee for the correction of this situation. This fee is independent of HostPaket and will be used to clear the IP block from e-mail blacklists. By using our services, you agree that in such cases, you will pay the required fee within the requested time period without objection.

4.) Payment
As long as you receive service from HostPaket, you agree to pay HostPaket for the service you receive.

HostPaket can only provide services to citizens of the Republic of Turkey as end users. HostPaket reserves the right to sell services to commercial enterprises registered in the Republic of Turkey. HostPaket, as an end-user to the citizens of the Republic of Turkey legal invoice submission will be made digitally, while the right to issue paper invoices is reserved by HostPaket.

HostPaket reserves the right to change the prices of the products at any time without notice.

In the event that the disk space, traffic and similar resources you have purchased are used more than the amount purchased, HostPaket will charge you for the cost of the resources used. In such a case, you are responsible for paying the required fee within the requested period without objection. In case of non-payment, your account will be terminated without refund and HostPaket will not be responsible for any pecuniary/non-pecuniary damages and data loss.

You are responsible for all material and immaterial damages caused to HostPaket in case of dispute, chargeback, etc... made by using payment channels without HostPaket's knowledge and/or permission.

5.) Backup and Data Loss
You are responsible for all your data while using our services. HostPaket offers the backup service as a convenience to you and does not guarantee backups. HostPaket cannot be held responsible for any data loss you may experience for any reason.

6.) Service Cancellation and Refund
HostPaket reserves the right to terminate any service at any time, with or without notice, without refund or partial refund, without giving any reason.

Sites that directly or indirectly damage our servers and/or cause problems such as slowdowns/interruptions, or receive attacks may be terminated without notice and without refund. In such cases, HostPaket may require you to compensate for the damages incurred. In such a case, you are responsible for paying the required fee within the requested period without objection.

For paid services, if the service is canceled before the expiration of the service period (for reasons such as use in violation of the service agreement, user request, etc.), the full service fee or the fee for the unused period will not be refunded. You can use the credit in your account for the services you can receive from us, but no refund or credit will be added to your account for services that will be terminated early.

7a.) Use of the Service

7aa.) Web Hosting/Reseller Hosting
Unauthorized actions:
a) It is strictly forbidden to send bulk e-mails and SPAM e-mails for any reason whatsoever. The e-mail services are made available to you to be used for your normal correspondence only.
b) HostPaket reserves the right to sanction applications that exceed 90 seconds on the shared server and use 25% more overall CPU load.
c) It is forbidden to run any server-based programs on our servers. This includes server-based programs such as IRCD.
d) It is forbidden to run spider or indexer programs such as Google Cash/AdSpy.
e) It is forbidden to run any software that communicates with IRC (Internet Relay Chat) networks.
f) Running any proxy application is prohibited.
g) Running any bit torrent application is prohibited.
h) Any file sharing/peer-to-peer application cannot be run.
i) Each web hosting account is limited to receive a maximum of 250,000 files.


7ab.) VDS/Rented Server

Unauthorized actions:
a) It is strictly forbidden to send bulk e-mails and SPAM e-mails for any reason whatsoever. The e-mail services are made available to you to be used for your normal correspondence only.
b) In VDS services, resource intensive use cannot be made in any way to damage other VDSs. This problem is usually caused by intense disk activity.
c) Running any proxy application is prohibited.
d) Any file sharing/peer-to-peer application cannot be run.


7b.) Backup Limit
Customers who continuously make backups that HostPaket considers unnecessary may have their service(s) suspended/terminated with/without notice. This clause applies if the server is damaged by using the backup service for purposes other than backup.


7c.) Unlimited Web Hosting
a) Unlimited web hosting services include only the hosting of your website files and only the traffic of your website.
b) Unlimited web hosting space cannot be used for data storage and/or backup space.


8.) Traffic Usage
You will have a certain traffic limit according to the package you have purchased. If this limit is filled/exceeded, the purchased service(s) may be automatically suspended until the next month or until more traffic is purchased. You are responsible for tracking the used traffic. Unused traffic cannot be transferred to the next month. Any usage over the purchased traffic will be billed the following month and you agree to pay this fee within the requested period without objection.

9.) Uptime Guarantee
If the 99% uptime guarantee guaranteed by HostPaket is not fulfilled, HostPaket is responsible for providing one month of free usage for the relevant service upon your request. Uptime reports reported by third party monitoring software are not valid for HostPaket, HostPaket keeps and publishes uptime reports itself.

Uptime guarantee is not valid during attacks on the server by malicious people in order to keep the server down and during previously specified server maintenance. In case of interruptions for this reason, the interruption will not be reflected in the uptime rate.

10a.) Scope of Support
You agree that HostPaket will not provide any support for issues not covered by the service you receive. For any hosting service received, HostPaket is not obliged to provide software support and user operations (mail account opening / mail setting, database creation, etc.). In VDS/rental server services, support is provided only for restoring the system to the state in which it was first delivered, additional software installations-user operations are not included in the scope of support. In software services, HostPaket is only obliged to deliver a smoothly working software.

In order to benefit from the support system, you need to log in to your customer panel with your password and send a support notification from the Support Notifications section. No other means (e-mail, telephone, live support, contact form, etc.) are used to share any information about the account and no action is taken.

10b.) 24/7 Support and Support Provision Time
The concept of 24/7 support does not mean that you will be reached every time you call by phone / that you will receive an immediate response to your support notifications. Our support team will try to respond to your ticket as quickly as possible. 24/7 support means that we work without working hours and depending on the intensity of the support team, the response you will receive to your support notification is a maximum of 24 hours unless exceptional circumstances occur.

11.) Reseller Hosting: Customer Responsibility
If you are getting a reseller hosting account, you are responsible for supporting your own customers. HostPaket will not support customers of reseller hosting users. If a customer of any of our reseller hosting users contacts us, HostPaket has the right to suspend your account until you take care of your own customer. Also, our reseller hosting users are responsible for the content of their own customers' sites. HostPaket can in no way be held responsible for any illegal behavior and breach of contract by the customers of our reseller hosting users.

12.) VDS and Dedicated Server
HostPaket reserves the right to reset the password of any VDS or rental server service it offers. It is the customer's responsibility to keep a valid e-mail address and root password registered in our system. VDS and rental servers are not backed up by us, all data and data backup is the responsibility of the customer.

13.) Co-Location (Server Hosting)
HostPaket reserves the right to reset the password of the server on any server hosting service it offers. It is the customer's responsibility to keep a valid e-mail address and root password registered in our system. The hosting service area is not backed up by us, all data and data backup is the responsibility of the customer. HostPaket reserves the right to hold the hosted server and other equipment hostage until the payment is made with legal interest in case of payment delays in server hosting services.

14.) Price Change
For the service you have purchased, you will not be charged an additional fee for the duration of the service you have purchased, unless you purchase an additional feature or use beyond the limits allowed to you. HostPaket reserves the right to change prices at the end of the service period and renew the service with new pricing.

15a.) Loss Coverage
By receiving service from HostPaket, you agree that you will not harm HostPaket in any way, you will not cause any material / moral damage and you undertake to compensate for any material / moral damage caused.

15b.) Legal Obligations
By receiving services from HostPaket, you agree not to give HostPaket any legal liability. In such a case, you undertake to cover all court and attorney costs within the requested period.

16.) Waiver
HostPaket cannot be held responsible for any damage to your business. HostPaket makes no warranties of any kind with respect to the service(s) it provides. This includes data loss, delays, interruptions, incorrect information delivery caused by HostPaket and any HostPaket employee. HostPaket will not accept any responsibility if your data/information is obtained by 3rd parties in a hacking incident that may occur.

17) Providing Legal Information
HostPaket is obliged to provide any information requested to legal authorities when necessary. This information may, where necessary, include your private information.
